1. Acceptance of Terms

By accessing or using Ancestry Echo's services, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our services.

2. Description of Service

Ancestry Echo provides a platform for creating digital avatars using artificial intelligence technology, including voice cloning, visual cloning, facial recognition, and personality mapping. Our service allows users to preserve their digital essence for future interactions.

3. Age Requirements and Parental Consent

Minimum Age

Ancestry Echo is not intended for children under 13 years of age. By using our service, you represent that you are at least 13 years old.

Users Ages 13-17

If you are between the ages of 13 and 17 (inclusive), you must have your parent or legal guardian's permission to use Ancestry Echo. By using our service, you represent that you have obtained such permission.

Parental Consent Requirements

• Parents/guardians must review these Terms and our Privacy Policy
• Parents/guardians must provide explicit consent for users under 18
• Parents/guardians are responsible for monitoring their child's use of the service
• We may request proof of parental consent at any time

Age Verification

We reserve the right to verify your age and may terminate accounts that violate our age requirements. If we discover that a user under 13 has created an account, we will immediately delete the account and all associated data.

4. User Accounts

Account Creation

• You must meet the age requirements specified in Section 3
• You must provide accurate and complete information, including your date of birth
• You are responsible for maintaining account security
• You must notify us immediately of any unauthorized access
• Only one account per person is permitted

Account Responsibilities

You are responsible for all activities that occur under your account and for maintaining the confidentiality of your password. Parents/guardians are responsible for accounts created for minors with their consent.

5. Acceptable Use

You agree not to use our service to:

• Violate any laws or regulations
• Infringe on intellectual property rights
• Create avatars of individuals without their consent
• Harass, abuse, or harm others
• Distribute malware or harmful code
• Attempt to gain unauthorized access to our systems
• Use the service for any illegal or fraudulent purpose

6. Content and Ownership

Your Content

You retain ownership of all content you upload, including voice recordings, images, and personal information. By uploading content, you grant us a license to use it solely for providing our services to you.

Our Technology

All AI models, algorithms, and platform technology remain the property of Ancestry Echo. You may not reverse engineer, decompile, or attempt to extract our proprietary technology.

7. Privacy and Data Protection

Your use of our service is also governed by our Privacy Policy. We are committed to protecting your personal data and the data of your digital avatars.

8. Payment Terms and Pricing

Subscription Fees

• Subscription fees are billed in advance on a monthly or annual basis
• All fees are non-refundable except as required by law
• Failure to pay may result in suspension or termination of service

Pricing Flexibility

As we continue to build and improve our product, we reserve the right to:

• Change subscription prices at any time with or without notice
• Modify, add, or remove service tiers and features
• Implement new pricing models including usage-based billing
• Adjust limits on avatars, chat time, or other service features
• Discontinue or modify promotional pricing at our discretion
• Apply different pricing to new vs. existing customers

Price changes will take effect immediately for new subscriptions and at the next billing cycle for existing subscribers. Your continued use of the service after a price change constitutes acceptance of the new pricing.

9. Account and Data Deletion

Delete Your Account Anytime

You have complete control over your account and data. You can delete your account and all associated avatars, recordings, and personal information at any time by:

• Going to your account settings and clicking "Delete Account"
• Contacting our support team at support@ancestryecho.ai
• Following the account deletion process in your dashboard

What Gets Deleted

When you delete your account, we permanently remove:

• All your digital avatars and AI clones
• Voice recordings and audio data
• Facial recognition data and images
• Personality profiles and knowledge graphs
• Chat histories and conversation logs
• Family tree data and relationships
• All personal information and account details

Immediate Deletion

Most data is deleted immediately upon account deletion. Some backup systems may retain data for up to 30 days for technical recovery purposes, after which it is permanently purged from all systems.

10. Intellectual Property

The Ancestry Echo name, logo, and all related marks are trademarks of Ancestry Echo, Inc. All other trademarks are the property of their respective owners.

11. Disclaimers and Limitations

Service Availability

We strive for 99.9% uptime but do not guarantee uninterrupted service. We may perform maintenance that temporarily affects availability.

Accuracy of Avatars

While we use advanced AI technology, we cannot guarantee perfect replication of voice, appearance, or personality. Avatars are approximations based on provided data.

Limitation of Liability

To the maximum extent permitted by law, Ancestry Echo shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our service.

12. Indemnification

You agree to indemnify and hold harmless Ancestry Echo from any claims, damages, or expenses arising from your violation of these Terms or your use of the service.

13. Termination

We may terminate or suspend your account at any time for violation of these Terms. You may cancel your account at any time through your account settings.

Effect of Termination

• Upon termination, your right to use the service ceases immediately
• We may delete your data after 30 days unless legally required to retain it
• You may request data export before termination

14. Governing Law

These Terms are governed by the laws of California, United States, without regard to conflict of law principles.

15. Changes to Terms

We may modify these Terms at any time. We will notify users of material changes via email or platform notification. Continued use after changes constitutes acceptance.
